General Terms and Conditions (GTC) – Atelier 9 KG Photography
1. Scope
These terms and conditions apply to all photography services, contracts, and assignments between Atelier 9 KG, owner Karim Zaatar, and the client. Any differing conditions from the client are not recognized unless explicitly agreed to in writing by Atelier 9 KG.
2. Conclusion of Contract
The contract is concluded upon written confirmation of the order or acceptance of a quote by Atelier 9 KG. Any changes or additional agreements must be made in writing.
3. Scope of Services

Atelier 9 KG provides photography services as agreed (e.g., portraits, events, product photography).

The scope of services is determined individually prior to the assignment and documented in writing.

Image editing is performed to the best of our ability and according to artistic discretion.
4. Pricing and Payment

Prices are based on the current price list or individual agreement.

Payment is due within the agreed timeframe after invoice issuance.

In case of late payment, Atelier 9 KG reserves the right to charge interest and reminder fees.
5. Usage Rights

All photographs remain the property of Atelier 9 KG.

Upon payment, the client receives a non-exclusive license for the agreed purpose.

Any additional use (reproduction, publication, commercial use) requires written consent from Atelier 9 KG.
6. Copyright
All images and content are protected by copyright and created by Karim Zaatar / Atelier 9 KG.
Unauthorized use or distribution is prohibited.
7. Delivery

Agreed-upon photographs will be delivered digitally (download link, USB) or physically as stated in the contract.

Delivery times are estimated and delays do not entitle the client to compensation.
8. Liability

Atelier 9 KG is only liable for damages caused by intentional misconduct or gross negligence.

No liability is accepted for damages resulting from improper use of the photographs.
9. Cancellation

Cancellations must be made in writing.

Depending on the timing, cancellation fees may apply (minimum 30% of the order value, unless otherwise agreed).
10. Data Protection
Personal data of the client is processed in accordance with GDPR. For more details, see our Privacy Policy.
11. Governing Law and Jurisdiction

Austrian law applies.

Jurisdiction for all disputes is Graz, Austria.
